Introduction

         =20 Jim Christiansen announced that this would be his last = Stakeholder=20 Group meeting.  He will be = leaving=20 the Upper Silver Creek project.  = He=20 announced that Peggy Churchill will be taking his place as EPA Project = Manager=20 for the cleanup.  He said = that Peggy=20 shares his style of doing things by keeping things calm and quiet.  In light of the transition, = Jim asked=20 the group to speak about how they felt the project was going.

           =20 Dana Williams said that, overall, the project is going well.  He said the citizens are calm = and the=20 perception is good regarding the cleanup. =20 He feels everyone involved knows more now about =93what we=92ve = got and what=20 we have to get done=94. Ultimately, he would still like to see = Prospector Square taken off CERCLIS.  He said the Soil Ordinance at = Prospector=20 seemed to be working well, noting that the $500 credit from the city to = the=20 homeowners really helped get people involved.

           =20 Tim Ingwell added that the Stakeholder Group should continue, as = it is=20 essential to what needs to be done at Silver Maple Claims.  Kerry Gee remembered feeling = =93uneasy=94=20 when the group first started meetings. =20 The meetings were =93tremendously more stressful=94 than they are = now, he=20 said.  He noted that = people in the=20 community are still interested in the cleanup, despite our recent = meetings where=20 hardly anybody showed up.  = He said=20 he gets a lot of phone calls from people whenever they hear Jim, Peggy, = or other=20 Stakeholders on the radio, especially when they hear something they = don=92t=20 like.  This is important = to keep in=20 mind, he said, because the cleanup will continue to move forward and = there are=20 still huge issues to tackle.  = He=20 said overall the cleanup has been good for the community.

           =20 Kerry also said that the watershed investigation has been a big = victory=20 for science in the watershed.  = He=20 feels we now know the specifics of what we need to do, like dealing with = the=20 zinc at Richardson Flat and moving dirt at Empire Canyon. And, he added, we=92re = doing it=20 logically.

           =20     John = Whitehead=20 said that the Stakeholder Group has dovetailed nicely with the TMDL=20 process.  =93Everyone = agrees that the=20 cleanup issue is there and we have to do this,=94 he said.  =93This group can keep the = momentum for it=20 going.=94

           =20 Mo Slam, Sally Elliot, and Bob Wells all agreed that the = Stakeholder=20 Group process has been good.  = Mo=20 said he liked the fact that it took a process that used to look at = things piece=20 by piece and now looks at it as a whole. =20 Bob Wells said he didn=92t believe at first that the process = could work,=20 but believes the Group has worked well.

           =20 Jim Christiansen said that some of the toughest cleanup issues = still=20 remain.  But the Day Lodge = is an=20 example, he said, that we can get a good common sense solution rather = than a=20 long, painful process. =93You can read about those in the papers,=94 he = said, =93but=20 you don=92t read about Park City.=94

 

           =20 Richardson = Flat

         =20 Kerry Gee recounted the Proposed Plan public meeting held = in=20 September.  He said just 2 = or 3=20 people attended other than agency people and we received a few comments=20 regarding moving materials from Empire Pass to Richardson Flat.  The comments are in a = responsiveness=20 summary that will be issued with the Record of Decision for Richardson = Flat=20 soon.  He also said a cost = agreement=20 and a consent decree are coming.  = This winter they=92ll be looking at what kind of work to do at = Richardson=20 Flat this summer, then they=92ll look at future uses which are still up = in the air=20 =96 golf, recreation sites are possible, but nothing is really = decided.

           =20 There was a small discussion about the Talisker Corporation.  Dana said he was impressed so = far.  Kerry said the company is the = same, just=20 with different shareholders.  = He=20 said Talisker is very committed to the cleanup.  Tom Bakaly added that Talisker = applied=20 to the city for a conditional use permit. =20 There will be a hearing on Dec. 8 before the planning = commission.  If appealed, it will go to the = City=20 Council in early January.  =

           =20 Dana noted that one of the council members is part of the Marsac = group=20 looking at an option of sending trucks from Empire Pass down Royal = Street instead=20 of Marsac on their way to Richardson Flat, which he feels would be = =93ten times=20 worse=94.

           =20 Bob Wells said the issue really is not contamination but the = trucks.  Most seemed to agree.  Ron Ivey said there are = options being=20 considered such as brake check stations and highway patrol inspection = stickers=20 on the trucks.  Dana said = delay=20 could happen if the council wants a new study on the make-up of the = material=20 coming down in the trucks.  = Kerry=20 noted that all of the dirt is coming from the Empire Canyon=20 stream channel and the area of the Flagstaff development, none from the = Daly West=20 mine dump.  In other = words, it=92s=20 already material that=92s already been moved once.  Jim Christiansen said that EPA = will=20 support =93whatever you all work out=94.

           =20 Jim said that the consent decree is just an agreement between EPA = and=20 UPCM.  But the natural = resources=20 damages settlement concerning Richardson Flat could be a difficult = process to=20 work out what=92s fair compensation to the government.  He said there should be some = plan,=20 however, that could be worked out.

         =20

Empire=20 Canyon

         =20 Kerry Gee said that Empire Canyon cleanup got started late = =96 it=92s=20 about 30 percent complete to date. =20 There is about 4,500 linear feet of drainage channel to restore = within=20 the Empire=20 Canyon.  This summer he said they=92ll = be able to=20 complete the stream channel including Walker and Webster channels and work = on the=20 surrounding mine dumps, etc=85 In the summer of 2006, they=92ll complete = last couple=20 1000 feet of stream channel just above the Daly Canyon=20 and then be done completely with Empire Canyon.

           =20 Jim Christiansen said that Empire Canyon has been on CERCLIS since = 1997 and=20 Richardson Flat since 1981, and=20 both will be cleaned up in the next two years.

 

Fish Consumption = Advisory=20

           =20 John Whitehead said they found that 25 percent of the fish in the = lower=20 part of the canyon have elevated arsenic, but the advisory went out for = all of=20 Silver Creek.  He passed = out copies=20 of a news release and fish advisory. =20 He said they=92ll continue to monitor every two years and will = look at Deer=20 Creek and Poison Creek - next time will be 2006.  Ron Ivey noted that he=92d = like to see=20 achievable stream standards set and not focus on the fish study because = the fish=20 will be taken care of if we focus on stream standard.  Jim Christiansen said he = wasn=92t sure if=20 achieving the water quality standard was =93doable=94, but said that = what we=92re=20 trying to do is make a resource what it can be, and if we meet the water = quality=20 standard =96 great.

           =20 John Whitehead said that the original TMDL was for cadmium and = zinc and=20 won=92t change because of the arsenic found in the fish.  The arsenic, he said is mostly = being=20 seen in the biota, not in the water column, so they are probably picking = it up=20 from the sediments.  Dana = said he=20 would like to see phosphorus/nitrate study because of the development = and golf=20 courses above.  Jim said = that the=20 lower Silver Creek Meadow area is not in CERCLIS, so the Group should = come up=20 with creative cleanup strategies for it.

           =20 John passed = around a=20 report titled =93Health Consultation: Fish=20 Sampling in Silver Creek Analysis of Metals and Potential Health=20 Impacts=94.

Soils Ordinance

         =20 Tom Bakaly gave a summary of the =93Soils Ordinance Area Environmental = Management System 2004 Annual Report=94 to the Group:

=B7        =20 48 properties were issued a certificate = of=20 compliance

=B7       =20 10 properties participated in Top Soil = Assistance=20 Program and got $500 from the City. =20

=B7       =20 34 properties volunteered to be sampled = =96=20 XRF

=B7       =20 4 did not meet EMS standards but have been corrected

=B7       =20 24 properties had wet chemistry and all = were=20 within the EMS requirement.  These had been capped years = ago

=B7       =20 all but 4 properties that the city knows = of are=20 in compliance.

 

Dana said that he = thinks the=20 community is well-educated about the Ordinance now.  There were a substantial = amount of=20 residents who went and got blood tests, he said.  He also said that the real = estate=20 community has been very helpful and involved.

 

Silver Maple Claims

           =20 Tim Ingwell said that BLM has contracted with Ken Kolm of Argonne = Report=20 fame to do a groundwater study.  = Tom=20 Bakaly asked about the motive for the groundwater study:  Was it a PRP identification = motive or=20 purely technical?  There = was a short=20 discussion about this.

 

Prospector Drain

         =20 Tom Bakaly said the pilot program to reduce zinc has = resulted in a=20 reduction from 6.2 milligrams to 2.6 milligrams.  He said the City will discuss = biocells=20 at a meeting on Dec. 15.  = John W.=20 asked about cadmium.  Tom = B. did not=20 know but would let him know after the 15th.  Ron Ivey noted that there is a = flow=20 meter at the drain too that shows little fluctuation in flow.  The biocell will run through = the=20 winter.  Tom Bakaly asked = Tim=20 Ingwell why BLM did not participate with the biocell, and Tim answered = that BLM=20 had some concerns that were not answered such as who would maintain = it.

 

Lower Silver Creek

         =20 Anne Tillia discussed the Nov. =9201 Innovative = Assessment. And said=20 there is a reoccurring question: What=92s there and how bad is it?

She passed out a summary of data collected in the = past.

 

Conclusion

         =20 Jim said that there would be less frequent Stakeholder = meetings=20 because there is more of a need at this point in the process for = smaller,=20 technical groups.  Peggy = said she=20 would like to set the next meeting for February.
